TCS Nashik Case: Five Accused Get Bail in Four FIRs, Remain in Jail

A Nashik sessions court has granted bail to five accused in four FIRs related to the alleged sexual harassment case at the TCS Nashik office.

However, the accused will continue to remain in jail as their bail applications are still pending in at least two other cases. Two women, Nida Khan and Ashwini Chainani, who were arrested in only TCS Nashik case, were released earlier after being granted bail.

On July 30, Additional Sessions Judge A.V. Kharkar granted bail to Raza Memon, Shahrukh Qureshi, Asif Ansari, Shafi Shaikh and Tausif Attar.

The court said the accused had spent more than three months in jail, the chargesheet had already been filed, and the investigation was almost complete.

“The accused are behind bars for over three months. The chargesheet is filed. Investigation is practically complete. There is no serious apprehension that the accused, if released on bail, would threaten the prosecution witnesses or tamper with the evidence,” the court said in its order.

Nine FIRs Registered Against Former TCS Employees

One of the FIRs alleges that Raza Memon made objectionable remarks to a woman colleague and hurt her religious sentiments, while the other four accused allegedly supported his actions.

The Nashik Police have registered nine FIRs in the case—eight at Mumbai Naka Police Station and one at Deolali Camp Police Station—under various sections of the Bharatiya Nyaya Sanhita (BNS).

Police have arrested eight former TCS employees. While some have been named in only one FIR, others are facing charges in multiple cases.

Accused Still in Jail Due to Pending Cases

Advocate Baba Sayyed, who represents some of the accused, said that although the five men have received bail in four FIRs, they are still in jail because their bail applications are pending in at least two other cases.

Two women accused, Nida Khan and Ashwini Chainani, who were arrested in only one case each, were released earlier after getting bail.

The prosecution opposed the bail, saying the accused had created a hostile work environment and sexually harassed the complainants. It also argued that their actions amounted to an attempt to commit rape. However, the court noted that this charge was not included in the chargesheet.

In another development, Danish Shaikh was granted bail on July 20 in a separate case in which he is accused of coercing a male colleague and making remarks that hurt his religious sentiments. He also remains in jail as he is an accused in another pending case.
